In view of outbreak of COVID-19 pandemic, case has been taken up through Video Conferencing. Concerned lawyers have no objection with regard to the proceeding, which has been held through Video Conferencing today at 10:30 A.M. onwards. They have no complaint in respect to the audio and video clarity and quality.

Petitioners are accused in a case registered under Sections 406/ 408/ 407/ 34 of the Indian Penal Code in connection with Golmuri P.S. Case No. 167/2018, pending in the Court of Judicial Magistrate, 1st Class, Jamshedpur.

Ms. Ritu Kumar, learned counsel appearing for the petitioners submits that there is apparent delay of six months in lodging the FIR, which smacks of malafide. Due to personal reasons petitioners had left the job but they were being pressurized to rejoin the duties. Since petitioners did not join the duties, they have been dragged in a false case in order to pressurize them.

Ms. Vandana Bharti, leaned APP vehemently opposes the prayer for bail of the petitioners. Learned APP submits that this is a serious case where custodian of the money has defalcated the same. The Banking business runs on trust and once trust is questioned, the entire system may collapse.

After hearing the parties and on perusal of the records, it appears that there is serious allegation against the petitioners. No ground is made out for enlarging the petitioners on bail at this stage.

In the circumstances, prayer for grant of anticipatory bail stands rejected.
