Judgment

This first application under Section 438 of Criminal Procedure Code, 1973 for grant of anticipatory bail has been filed by the applicant, who is apprehending his / her arrest in connection with Crime No.349/2021 registered at Police Station Dindayal Nagar, District Ratlam (MP) for offence punishable under Sections 302, 323, 294, 324/34, 147, 148, and 149 of the Indian Penal Code, 1860.
After arguing for some time on the merits of the matter, counsel for the applicant seeks leave of this Court to withdraw this application with a liberty to surrender the applicant before the lower Court. It is further prayed that the learned Judge of the lower Court may be directed to decide the applicant's regular bail application expeditiously.
Prayer appears to be reasonable.
In these circumstances, the application is dismissed as withdrawn with a liberty to the applicant to surrender himself / herself before the lower Court within one week from today; and if the applicant surrenders within such a period, then his / her application for grant of regular bail may be considered by the learned Judge of the lower Court expeditiously, in accordance with law.
Accordingly, Miscellaneous Criminal Case No.53368/2021 stands disposed of.
