The Petitioner is an accused in connection with T.R. Case No.421 of 2022, pending before the Court of the learned 3rd Addl. Sessions Judge, Bhubaneswar, arising out of Balianta P.S. Case No.354 of 2022, for commission of the alleged offence under Section 21(c)/29 of NDPS Act.

4.

Learned counsel for the Petitioner relies on the order dated 25.09.2023 in respect of the co-accused passed by this Court in BLAPL No.4199 of 2023 and seeks release of the Petitioner inter alia on the ground of parity.

5.

It is submitted by the learned counsel that the Petitioner is in custody since 24.09.2022 and he is the first offender and the allegation against him is of seizure of contraband to the tune of 130gms (Brown Sugar) like the co-accused who has since been released.
