Judgment
Heard.
This is an application for grant of bail to the applicant, who is in jail in connection with Crime No. 503/2019 registered by Police Station, Washim, Tq. and District Washim for the offence punishable under Sections 436, 427, 511 and 506 read with Section 34 of the Indian Penal Code.
Learned APP seeks further time to file reply.
Learned counsel for the applicant prayed for an interim protection.
It is submitted that the co-accused Govinda Ambhore, who is similarly situated with the present applicant, has already been released on bail by the learned Sessions Court, Washim and thus prayed for releasing the present applicant on bail on the ground of parity.
The applicant is stated to be in jail since 19/10/2019. It is also stated that the investigation is completed and the chargesheet has also been filed.
Considering the nature of allegations levelled against the applicant so also considering the fact that there is no past criminal antecedent available against the applicant in the chargesheet, I am inclined to protect the applicant pending hearing of this application. Hence, the following order :-
ORDER.
The Criminal Application is allowed.
The applicant Akkya @ Akash s/o Ganesh Gawali shall be released on bail on his executing P.R. bond in the sum of Rs.15,000/-(Rs. Fifteen thousand only) with one surety in the like amount.
On being released on bail, the applicant shall mark his presence with the Police Station, Washim on first and sixteenth day of each month.
The applicant shall not tamper with the prosecution witnesses.
