This Interlocutory Application has been preferred by the appellants namely Jainandan Mahtha, Harinandan Mahtha, Dhananjay Mahtha and Sanjay Mahtha @ Sanjay Kumar Mahtha who are in custody in connection with S.T. No. 146 of 2012 (Gola P.S. Case no. 307 of 2011, G.R. Case no. 1260 of 2011) for grant of bail during the pendency of the appeal.
Heard both sides.
Learned counsel for the appellants has reiterated the arguments which she had advanced on the last occasion and also reiterated that there was no specific allegation attributed to any of the appellants and also there is no intention or intent made out u/s 307 I.P.C . She has further submitted that three witnesses have been examined and all have turned hostile. Hence, the appellants may be enlarged on bail.
Learned counsel for the State-APP has opposed the prayer for bail application.
Having regard to the facts and circumstances of the case, I am inclined to release the appellants namely Jainandan Mahtha, Harinandan Mahtha, Dhananjay Mahtha and Sanjay Mahtha @ Sanjay Kumar Mahtha on bail, during pendency of the appeal, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- II, Ramgarh in connection with S.T. No. 146 of 2012 (Gola P.S. Case no. 307 of 2011, G.R. Case no. 1260 of 2011).
Instant interlocutory application stands disposed of.
