Judgment
Hemant Gupta, J.—The grievance of the Petitioner is that 75 vacancies of Safai Sewak are available, but the services of the Petitioner are not being regularized, whose name appears at Sr. No. 55 in the list of the candidates, whose services are liable to be regularized. Therefore, the Respondents have failed to comply with the directions issued by this Court.
Earlier contempt petition filed by the Petitioner was taken up for hearing on 17.05.2010, wherein this Court has noticed the part of the order passed by the Director Public Instruction (EE), Punjab, Chandigarh to the effect that the services of the Petitioner will be regularized on her turn and her case will be considered on merit-cum-seniority. It was stated that the Petitioner''s services will not be terminated and will be regularized in accordance with her seniority.
It is not the case of the Petitioner that the services of any of the junior to the Petitioner have been regularized. Mere fact that vacancies are available does not create any right in favour of the Petitioner to claim regularization, as availability of vacancies itself is not confer any right on any person to seek appointment to the post.
In view of the above, I do not find that any ground for initiation of contempt proceedings is made out.
Dismissed.
