Heard learned counsel for the parties.

The Petitioner has filed this Writ Petition seeking direction to Opposite Parties No. 1 and 2 to sanction and disburse the decretal/awarded amount U/s. 28-A of L.A. Act, 1894 with statutory interest in favour of the petitioner as per the Calculation Sheet submitted by the Land Acquisition and Rehabilitation Officer, Upper Indravati Irrigation Project (Opposite Party No.3) before the Opposite Party No.2 on 08.06.2022 vide Annexure-2.

In course of hearing, learned counsel for the Petitioner states that considering his grievance, Opposite Party No.3 has submitted the up-to-date calculation sheet along with relevant documents before Opposite Party No.2-the Director (R & R), & Ex-officio, Addl. Secretary to Govt., Water Resources Department, Govt. of Odisha on 08.06.2022 for sanction of decretal dues U/s.28A of L.A. Act, 1894 in accordance with the orders passed in MJC No.39/2007 in favour of the petitioner. But the same is still pending for consideration. Therefore, Opposite Party No.2 may be directed to take a decision on Annexure-2 within stipulated time, to which learned counsel for the State has no objection.

As agreed by learned counsel for the parties and after going through the records, this Court disposes of the Writ Petition directing Opposite Party No.2 to consider the recommendation made by Opposite Party No.3 vide Annexure-2 and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order.

Issue urgent certified copy as per Rules.
