In response to the previous order an affidavit dated 6th September, 2022 of Sri Nabeen Kujur, Branch Manager of the Bank concerned has been filed in Court. Perusal of the same reveals that the property to be auctioned on 7th September, 2022 stands offered as a collateral security in two housing loan accounts, wherein the outstanding liability as on today is around Rs.20.00 lakhs. The third NPA account is a C.C. account without collateral security with outstanding liability of around Rs.16,31,956/-.

Counsel for the Petitioner submits that the Petitioner is prepared to pay more than 50% of the outstanding liability as upfront money with the remaining balance within next four months in order to save his sole residential property i.e., the secured asset.

Issue notice for 27th September, 2022.

Mr. B.N. Udgata, Advocate appears and waives off notice on behalf of the Bank/Opposite Parties.

Let requisite number of copies of the writ petition be served on him within next three working days.

As an interim measure, subject to deposit of a sum of Rs.10.00 lakhs on or before 7th September, 2022, the successful bid, if any, shall not be confirmed without the leave of the Court.
