Grievance of the petitioner is that her representation dated 25.4.2023 sent through proper channel as well as in advance to the Director, Women & Child Welfare Department is pending and her prayer for transfer has not been considered till date.
Learned counsel for the petitioner submits that petitioner is ready to file fresh representation in continuation of earlier representation and she shall be satisfied in case direction is issued to respondents to decide representation of the petitioner in time bound manner.
Learned Additional Advocate General submits that in case fresh representation is preferred by petitioner, the same shall be decided as expeditiously as possible, preferably within three weeks.
In aforesaid circumstances petitioner is permitted and directed to submit her fresh representation in terms of policy to respondent No. 2-the Director, Women & Child Welfare Department on or before 6th June, 2023 and in case such representation is preferred by the petitioner, the same shall be decided by respondent No. 2 on or before 30th June, 2023, by passing a speaking and reasoned order after giving opportunity of hearing to the petitioner, if desired so. Order so passed shall be communicated to the petitioner and in case petitioner is still aggrieved, she shall be at liberty to avail appropriate remedy.
Till decision of representation preferred by petitioner, in case stations mentioned in the representation are lying vacant or going to be vacated during pendency of representation, at least one station, out of such stations, shall be kept vacant, if not already filled.
The petition is disposed of in the aforesaid terms, so also pending miscellaneous applications, if any.
Parties are permitted to use copy of this order downloaded from the website of High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist for production of a certified copy, but if required, may verify passing of order from website of the High Court.
