Petitioners seek quashing of FIR No. 80/2023 of PS Nanak Pura for offences under Section 498A/406/34 IPC on the ground that they have compromised the disputes with the complainant de facto (respondent no. 2 herein).

All petitioners and respondent no. 2 are present in Court identified by their respective counsel and I have spoken with them in Hindi.

Respondent no. 2 submits that she has settled all her matrimonial disputes with the petitioners. As submitted by both sides, marriage between petitioner no. 1 and respondent no. 2 stands dissolved by way of decree of divorce with mutual consent. Parties have one daughter aged about 2½ years and they have decided that custody of their daughter shall remain with respondent no. 2 and as regards visitation, the same shall be permissible for petitioners subject to convenience of respondent no. 2. Respondent no. 2 submits that she has received her entire stridhan as well as full and final settlement amount towards alimony and now nothing is due to her. However, as regards rights of the daughter of the parties, all of them are aware that those rights shall remain intact. Respondent no. 2 submits that she is not interested to pursue prosecution of the petitioners.

Having spoken with the parties, I am satisfied that it would be in the interest of justice not to push them through trial.

Therefore, the petition is allowed and consequently FIR No. 80/2023 of PS Nanak Pura for offences under Section 498A/406/34 IPC as well as proceedings arising out of the same are quashed. Pending application stands disposed of.
