The present writ petition has been filed under Article 226 of the Constitution of India with the following prayers:-

“(i) Issue a writ, order or direction in the nature of certiorari for quashing the order dated 27/28th August 2024 issued by the office of Registrar GB Pant University of Agriculture and Technology Pantnagar, District Udham Singh Nagar, qua the petitioner whereby, the petitioner on the allegations of using unfair means during semester examination has been debarred for the academic year 2023-24. (Contained as Annexure no.3 to this petition),

(ii) Issue a writ, order or direction in the nature of mandamus directing the respondents to allow the petitioner to provisionally appear and persue B.Tech IInd year and onwards course for the academic session 2024-25.

(iii) Issue any other and further order or direction which this Hon’ble Court may deem fit and proper under the facts and circumstances of the case.

(iv) Award costs of the petition to the petitioner.”

Heard Mr. Sandeep Kothari, learned counsel for petitioner and Mr. Shubhang Dobhal, learned counsel for respondents.

Mr. Sandeep Kothari, Advocate, submitted that the present matter is covered by the judgment dated 02.11.2023, passed by the coordinate Bench of this Court in WPMS No.1612 of 2023, “Dipesh Phulera Vs. G.B. Pant University of Agriculture and Technology, Pantnagar, District Udham Singh Nagar and Others”, and, in WPMS No.1650 of 2023, “Himanshu Raj Vs. G.B. Pant University and Others”.

The said submission has not been disputed by the learned counsel appearing of the respondents.

With the consent of both the parties, the present Writ Petition (M/S No.2530 of 2024) is disposed of in terms of the said judgment dated 02.11.2023, passed by the coordinate Bench of this Court in WPMS No.1612 of 2023, “Dipesh Phulera Vs. G.B. Pant University of Agriculture and Technology, Pantnagar, District Udham Singh Nagar and Others”, and, in WPMS No.1650 of 2023, “Himanshu Raj Vs. G.B. Pant University and Others”.
