The instant appeal has been filed under Section 14(A) SC/ST (Prevention of Atrocities) amended Act on behalf of the appellant, who is in custody in connection with F.I.R. No.245/2022, Police Station Ahore, District Jalore for the offences under Section 376 of IPC and Section 3(2)(v) of S.C./S.T. Act against the order dated 19.01.2023 passed by the learned Special Judge, SC/ST (Prevention of Atrocities) Act Cases, Jalore, whereby, the bail application preferred under Section 439 Cr.P.C. on behalf of the appellant was rejected.
Learned counsel for the appellant submits that prosecutrix has been examined as PW.7 before the trial Court and there are material contradictions, improvements and omissions in her statement. The appellant is in judicial custody and the trial of the case will take sufficient long time to be concluded. Therefore, the benefit of bail may be granted to the accused-appellant.
Learned Public Prosecutor has opposed the prayer for bail.
I have heard and considered the arguments advanced before me and perused the material available on record.
According to the statement of prosecutrix, a specific allegation has been levelled against the appellant, therefore, this Court is of the opinion that the learned court below has not committed any error in rejecting the bail application of the appellant and this Court also does not find any good ground to give indulgence of bail to the present appellant.
Hence, the criminal appeal filed by the appellant for bail is hereby dismissed.
