Jaswant Singh. J.—Prayer in the instant petition u/s 482 Code of Criminal Procedure was for directing the official Respondents to hold an independent inquiry and further investigations in case FIR No. 112 dated 16.3.2010 registered at PS Hathin, Distt. Palwal, for the offences under Sections 148, 149, 323, 325, 302, 452, 506 and 212 IPC.

It was alleged by the Petitioner that named accused-17 in number had attacked the Petitioner and his family members, which resulted in the death of his brother-Yakub and resultantly the aforesaid FIR. It was further alleged by the Petitioner that police had arrested only 6 persons and besides that exonerated the main accused Shorab @ Chaudhary, the main accused who allegedly caused fatal injury on the head of deceased Yakub.

Notice of motion was issued.

Today at the time of hearing Mr. Shiv Kumar,Advocate has put in appearance on behalf of the Petitioner and states that he has been engaged by the Petitioner to pursue the present petition. He has filed his Vakalatnama with no objection from Sh. Satish Chaudhary,Advocate, who initially filed the instant petition.

Learned Counsel for the Petitioner states that the main grievance of the Petitioner was with regarding to putting the name of main accused Shorab @ Chaudhary in column No. 2 while presenting the challan. It is further prayed by him that the present petition be dismissed as withdrawn with liberty to Petitioner to seek his remedy before the trial Court at an appropriate stage qua placing of named accused Shorab @ Chaudhary in column No. 2 in the final report.

Allowed as prayed. Dismissed as withdrawn.
