Judgment

The instant writ application has been preferred by the petitioner for the following reliefs:
“(i) For issuance of an appropriate Writ(s), order(s), and/or direction(s), particularly a writ in the nature of Mandamus, commanding upon the respondents to allow the petitioner to join on the post of District Welfare Officer, Chatra with effect from 30.11.2015 i.e. the date on which the suspension of the petitioner has been revoked;
(ii) For issuance of an appropriate Writ(s), order(s), and/or direction(s), particularly a writ in the nature of Mandamus, commanding upon the respondents to immediately release and pay arrears of salary to the petitioner from 30.11.2015 till date:
(iii) For issuance of appropriate writ(s)/ direction(s) order(s) as Your Lordships may deem fit and proper in the facts and circumstances of this case in the interest of justice.”
No one appears for the petitioner, even on repeated calls.
Learned counsel for the respondents submits that prayer no.1(i) of the petitioner is to allow him to join the post of District Welfare Officer, Chatra with effect from 30.11.2015 and now 10 years has lapsed. Learned counsel further relies upon the counter affidavit and submits that the petitioner is not entitled for any relief.
Looking to the prayer made in this writ application especially the prayer no.1(i) it appears that it has practically become infructuous and so far as payment of arrear of salary from 30.11.2015 is concerned, it has already been answered in the counter affidavit that initially petitioner was terminated and thereafter matter was remitted to the Department to reconsider. It appears that the petitioner has lost interest in this case and accordingly the instant writ application stands dismissed for non-prosecution.
