Heard on the question of admission. Perused the impugned orders and petition, petition seems to be arguable hence admitted for final hearing.
Also heard on I.A. No. 17937/12 an application for grant of bail.
Applicant Babulal has been convicted u/ss 279, 337 and 304-A of IPC and sentenced to fine of Rs. 1,000/- and Rs. 4000/- by J.M.FC/Gram Nayalalya Sihore dist. Sihore in Criminal Case No. 32/11 on 25.05.2012 and in appeal bearing no. 145/12 learned Sessions Sihore vide judgment dated 14.8. 2012 dismissed the appeal
Looking to the nature of punishment and the nature of the case and the fact that this revision is not likely to be heard and disposed of at an early date I.A. No. is allowed. It is directed that if the accused/applicant Babulal pays the fine and furnishes personal bond to the tune of Rs. 25,000/-(Rs. Twenty five thousand only) with a surety bond in the like amount to the satisfaction of the trial Court for his appearance before this Court on 21.12.2012 and continue thereafter as may be directed, he be released on bail and the substantive jail sentence shall remain suspended during pendency of this revision.
