Judgment
Heard the parties.
The applicants, who are in custody since 17.01.2023, have approached this Court for grant of regular bail in connection with (S.T. No.181 of 2023) arising out of Chandankiyari (Baramasia OP) P.S. Case No.13 of 2023 registered for the offence under Sections 302/34 IPC.
It appears that the applicants are accused of committing murder.
It has been submitted by the counsel for the applicant(s) that complete set of FIR/ Complaint Case along with its enclosure have been annexed with this bail application and there is no suppression on his part.
Innocence has been claimed and participation in the trial has been assured. It has been submitted that it is at best present case will fall under Section 304 IPC. Charge has already been framed on 15.05.2023. On the above basis, prayer for bail has been made.
On the other hand, learned A.P.P. has opposed the prayer for bail.
Considering the above facts and the fact that charge has already been framed, I am inclined to enlarge the applicant (s) on bail. Accordingly, the applicant(s), above named, are directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-I, Bokaro, in connection with (S.T. No.181 of 2023) arising out of Chandankiyari (Baramasia OP) P.S. Case No.13 of 2023 on the condition that the applicant(s) will submit self-attested photocopy of their Aadhaar Card(s) and also submit this mobile number(s) before the learned court below which they will always keep active and will not change it during pendency of this case without prior permission of the court.
