Though it is not in dispute interse the parties to the lis that the petitioner has completed the normal tenure, of, three years, at the present place of posting, but since the mother of the petitioner is 87 years old and is suffering from many ailments, this Court deems it fit to afford an opportunity to the petitioner to file a representation to the authority concerned, praying therein for his posting, at the stations, near Rakkar, District Kangra, H.P.

Consequently, the instant petition is disposed of with the direction to the petitioner to file a representation before the respondent concerned, within a period of 10 days from today, which shall be considered by the respondent concerned, sympathetically. Needless to say, while considering the afore representation, the petitioner shall be afforded an opportunity of personal hearing, and his representation shall be decided by the authority concerned, by passing a speaking order. It is made clear that till the representation is not decided, the petitioner would be allowed to avail the leave of kind due, in terms of order dated 22.2.2021, passed by this Court in CWP No. 970 of 2021. Since in the aforesaid order, the respondents have been already directed to disburse the salary of the petitioner from the station concerned, this Court hopes and trusts that respondents would not make any delay, as far as the disbursement of the salary of the petitioner is concerned.

In view of above, the present petition is disposed of. The pending application(s), if any, are also disposed of. No costs.
