Under Section 439 of Cr.P.C. the BLAPL has been filed by the petitioner in jail custody, in connection with Bhadrak Rural P.S. Case No.318 of 2024 corresponding to G.R. Case No.1161 of 2024 pending in the court of learned Special Judge (POCSO)-cum-4th Additional District & Sessions Judge, Bhubaneswar for alleged commission of offences under Sections 376(2)(n) of I.P.C. read with section 6 of POCSO Act.
Learned Additional Standing Counsel for the State submits that he shall obtain up-to-date case diary/instructions in the matter.
An extra copy of the petition shall be served on the learned ASC to enable him to forward the same to the investigating officer who shall forward through his office to the informant/victim intimating them regarding their right of audience in the present proceeding. Another copy of the petition shall be filed in the Registry which shall be forwarded to the learned court in seisin of the matter so that the court can forward the same through its office to the informant/victim intimating regarding their right of audience in the present proceeding.
The Secretary, DLSA shall do well to provide legal aid to the informant/victim if they are unable to engage any counsel on their own. Learned counsel appearing on behalf of informant/victim shall have the liberty to appear through the nearby virtual court of High Court of Orissa to represent the informant/victim.
As prayed for, list in the week commencing 24. 06.2024 before the assigned Bench.
Up-to-date case diary/instructions/status of trial/statement of the victim if recorded under section 164 of Cr.P.C. and other relevant investigation reports be obtained by the learned ASC in the meantime.
