This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
This is an application U/S.439 of Cr.P.C. by the petitioner for grant of bail in connection with S.T. Case No.109 of 2022 arising out of Pattapur P.S. Case No.434 of 2021 pending in the file of learned 2nd Addl. District & Sessions Judge, Berhampur, Ganjam for commission of offences punishable under Sections 498-A/ 302/ 34 of the IPC r/w Section 4 of D.P. Act, on the allegation of committing murder of his wife by subjecting her to torture and cruelty for demand of dowry.
Heard, Ms. S. Patro, learned counsel for the petitioner and Mr. S.R. Roul, ASC in the matter and perused the record.
After having considered the rival submissions and taking into consideration the nature and gravity of accusations raised against the petitioner, especially when there is specific allegation against the petitioner for setting his wife to fire and taking into account the other circumstance on record in entirety, this Court is not inclined to grant bail to the petitioner.
Hence, the bail application of the petitioner stands rejected.
Accordingly, the BLAPL stands disposed of.
Issue urgent certified copy of the order as per Rules.
