1.

The appeal suffers from delay of 292 days and for condonation of delay thereof I.A. No. 807 of 2008 has been made. Even if we condone the delay, we find that the appeal does not deserve to be admitted. We heard Mr. Yugal Kishore, Senior Counsel for the appellants. It is not in dispute that the order of the statutory authority passed on 15.1.2001 under the Minimum Wages Act was carried in appeal by the present appellants. It is also not in dispute that the order of the appellate authority has not been challenged by the appellants at any point of time. Once the order dated 31st December, 2001 passed by the appellate authority attained finality, the view of the Single Judge that the challenge to the original order dated 15.1.2001 is not permissible, cannot be said to be erroneous.

This Letters Patent Appeal has no merit. It is dismissed in limine. This also disposes of I.A. No. 807 of 2008.
