Mr. Dash, learned advocate appears on behalf of petitioners and with reference to our order dated 16th February, 2023, presses for hearing.

Mr. Mishra, learned senior advocate appears on behalf of opposite party no.3 and submits, it will appear from said order dated 16th February, 2023 that claim of petitioners is based on dismissal of the writ petition. His client has applied for recall of said order by CMAPL no.336 of 222, moved before the first Division Bench on 14th October, 2022 and direction for issuance of notice made. Ms. S. Patra, learned advocate, Central Government Counsel appears for Union of India.

On query from Court Mr. Dash submits, his clients are unaware of the CMAPL. In the circumstances, we reproduce below text of order dated 14th October, 2022 made by the first Division Bench in CMAPL no.336 of 2022 (Parel Investment and Training Company Limited, Cuttack and another v. Presiding Officer, Central Government Industrial Tribunal and Labour Court, Bhubaneswar and others).

“1. Issue notice. Since Mr. B.S. Rayaguru, learned Central Government Counsel accepts notice for Opposite parties 1 and 2, let required number of copies of the petition be served on him within three working days.

Notice be issued to Opposite parties 3 to 12 by registered/speed post with A.D., making it returnable before the next date, requisites for which shall be filed within three working days.

List on 9th December, 2022.”

We require opposite party no.3 to serve copy of the CMAPL on petitioners. Mr. Mishra submits, it will be done by Monday (13th March, 2023).

Petitioners must obtain advice on steps to be taken. Mr. Mishra submits, CMAPL has been directed to be listed on 30th June, 2023.

Accordingly, list on 10th July, 2023.
