Bubesh Kumar and Others vs State of H.P. and Others

Kurian Joseph, C.J.—The writ petition is filed with the following prayers:

(i) That the Respondents may be directed to appoint to the Petitioners to the post of Artificial Inseminators by issuing writ of mandamus.

(ii) In alternatively if it is not possible to the Respondents department to appoint the Petitioners as Artificial Inseminators, then the Respondents department may kindly be directed to appoint the Petitioners as Class-IV employees in District Kullu, where 15 posts of various categories are lying vacant by issuing writ of mandamus.

In para 2, on merits of the reply, it is stated as follows:

para-2 That in reply to this para it is submitted that in the year 2002 District Rural Development Agency (DRDA) Mandi, District Mandi, Himachal Pradesh under the project called "Rural Development Through Diversification In Agriculture (Innovative Practice in Animal Husbandry)", had planned to established mobile artificial insemination location by providing better facilities (Motor-Bike etc.). For this two locations per Block in each of the Ten Blocks in District Mandi were to be selected and for this a task force of 20 persons were needed. For this purpose 20 persons were selected by the District Rural Development Agency, Mandi for two months inseminators training to be imparted at BAIF Centre Urli Kanchan Maharashtra and the total expenditure of the said training was also born by the District Rural Development Agency, Mandi, District Mandi. The said candidates were selected from the rural profile who were conversant with Animal Husbandry activities and had inclination to served for the cause of the animals. Out of the 20 candidates who were imparted training in the above said institute, five were already serving in the Animal Husbandry Department, H.P. as daily paid beldars. The District Rural Development Agency, Mandi, District Mandi had launched the scheme called "Rural Development Through Diversification In Agriculture (Innovative Practice in Animal Husbandry)" for the purpose of increasing the production of milk, providing breeding facilities with the artificial insemination, so that the families of Animal Husbandry Sector shall generate self employment potential and the milk so produced, shall be marketed directly by Self Help Groups (SHG), all through the already existing network of milk co-operative Societies of H.P. Milk Federation. The Department of Animal Husbandry has never given any assurance to the Petitioners that they will be given employment in the Animal Husbandry Department.

Admittedly, the Department required services of 20 persons and the Petitioners had been selected and also sent for training. Therefore, further action is to be taken by the first Respondent in view of the reply as above. In case the work is still available and in case the services of the Petitioners are required, the Department may take further steps for engaging the services of the Petitioners. We also make it clear that as and when the steps, as above, are taken, the Petitioners having once been selected and sent for training shall be preferably considered.

With the above observations, the writ petition stands disposed of, so also the pending application(s), if any.
