Judgment

[1] This order shall decide CWP No.24322 of 2015 and CWP No.22428 of 2017. Facts of the case are being taken from CWP No.24322 of 2015.
[2] Prayer in the writ petition is for the issuance of a writ of Certiorari to quash Order (Annexure P/10) dated 11.04.2017 passed by respondent No.2, rejecting representation (Annexure P/6) dated 25.08.2012 filed by the petitioner seeking parity with HAP Constables. Prayer is also for the issuance of a writ of Mandamus for directing the respondents to formulate a policy relating to the transfer/absorption of Constables of the IRB in the District Police.
[3] Learned counsel for the petitioners by referring to paragraph No.2 of Annexure R/2 contends that the Government has agreed with the proposal of the Director General of Police, Haryana, Panchkula to send the draft rules regarding merger of IRB personnel in the District Police on the pattern of Constable of HAP as contained in the proposal of the DGP, Haryana, Panchkula dated 02.07.2018 i.e. Annexure R/1 and that pursuant to communication contained in Annexure R/2, the Director General of Police, Haryana, Panchkula has constituted a Committee vide Annexure R/3, comprising of Shri A.S. Chawla, IPS, ADGP/Operations as Chairman, Shri Rajender Kumar, IGP/CMFS as Member and Dr. Hanif Qureshi, IPS, IGP/IRB also as Member, with a request to the Committee to prepare the draft rules expeditiously and to submit the same to him.
[5] Learned counsel states that in the circumstances, the petitioners would be satisfied, if at this stage, the writ petition is disposed of by directing the respondents to finalize the proceedings of the Committee and submit the draft rules to the DGP, for appropriate action in respect thereto at the earliest.
[6] Learned Senior Deputy Advocate General, Haryana, states that he has no objection to the limited prayer of the petitioner.
[7] In view of the statement of learned counsel for the parties, the writ petition is disposed of by directing the respondents to finalize the proceedings of the Committee, constituted vide Annexure R/3 and to take action on the recommendations of the Committee with regard to the draft rules, as expeditiously as possible, preferably within a period of 04 months from the date of receipt of certified copy of this order. Needless to mention, in case grievance of the petitioners subsists, they would be at liberty to seek redress in accordance with law.
