Judgment
M.A. No. 194 of 2024: This M.A. has been preferred by the original petitioner seeking interim relief against the communications which are annexed with the memo of this M.A. and especially in light of the earlier orders passed by this Tribunal in the present Telecom Petition with earlier M.As preferred by this petitioner and these orders are :
(I) Order dated 30.5.2016;
(II) Order dated 24.1.2017 ( in T.P. No. 76 of 2016 Reliance Telecom Ltd Vs Union of India) ; and
(III) Order dated 13.11.2017.
Learned senior counsel appearing for the petitioner seeks an interim relief to the effect that no coercive steps may be initiated by the respondent till the next date of hearing for the impugned communications which are issued in the year 2023 & 2024.
Notice upon respondent, which is accepted by Mr. Apoorv Kurup , counsel for respondent – Union of India and he is seeking time to take instructions and to file reply. Time to file reply is granted till next date of hearing.
In the meanwhile, no coercive steps shall be initiated by the respondent till next date of hearing in pursuance of the impugned communications which are annexed as Annexure-I, Annexure –K(colly) and Annexure –L(colly) with the memo of this M.A. No. 194 of 2024 which are demands for the year 2015 onwards for Spectrum Usage Charges (SUC).
List the matter under the heading “For Directions” on 10.9.2024, as already fixed.
In the meanwhile, the petitioner shall continue to make payment of the undisputed amount to the respondent.
