HEARD. The Complainant Society is supplying essential commodities as well as commodities mainly used for the purpose of agriculture to the agriculturists who are its members. The members give indents of their requirements to the Complainant Society which forwards them to the D.C.C. Bank for sanction of loan. After the loan is sanctioned the society placed orders for supply of 80 tonnes of fertiliser to the first Respondent. After getting fertiliser from the Respondent, the Complainant Society sells the fertiliser to the members who had placed indents. The said facts are not disputed before us by the learned Counsel for the Complainant. Hence, it is clear that the complainant had placed indent for the purchase of fertiliser with the respondent and as it was for the purpose of resale, the complainant will not be a consumer within the meaning of Section 2(1)(d)(i) of the Consumer Protection Act, 1986. If that is so, the complaint cannot be entertained. In the result, complaint is dismissed. Parties to bear their own costs. Complaint dismissed.
