L.N. Mittal, J.—Plaintiff Chand Singh Johal has invoked the jurisdiction of this Court under Article 227 of the Constitution of India seeking direction to the trial court (learned Additional Civil Judge (Senior Division), Moga) to decide the suit instituted by the Petitioner against the Respondents expeditiously in time bound manner.

I have heard learned Counsel for the Petitioner and perused the case file.

Perusal of zimini orders of the trial court Annexure P/2 clearly brings out the grievance of the Plaintiff-Petitioner. Evidence of the Plaintiff was closed by his counsel on 28.5.2008. Thereafter large number of adjournments have been granted for evidence of Defendants and it is, in fact, difficult to count the number of adjournments granted by the trial court for evidence of the Defendants. After availing so many adjournments, Defendants moved application on 4.12.2009 for directing Plaintiff to produce the map annexed with the conveyance deed. Thereafter, progress in the trial of the suit has halted for consideration of the said application and also a subsequent application moved by the Plaintiff for some formal amendment of the plaint. More than one year has lapsed since Defendant moved aforesaid application. The suit is now pending for 14.1.2011 for consideration of both the aforesaid applications.

In view of the aforesaid, the instant revision petition is disposed of by directing the trial court to dispose of the civil suit instituted by Petitioner against the Respondents (pending in the trial court for 14.1.2011) within six months of the receipt of certified copy of this order.
