Admit. Standing counsel takes notice for the 1st respondent. Government Pleader takes notice for the respondents 2 to 4.
The limited prayer in the writ petition is for a direction to the 1st respondent to consider and dispose of Ext.P3 application submitted by the petitioner seeking permission to wipe off the liability in respect of ARC No.498/2020 by availing the facility of One Time Settlement Scheme.
A detailed counter affidavit has been filed by the 1st respondent pointing out that several loans have been taken by the parties and amounts are due under the other loans also. However, I do not think those aspects need be considered, having regard to the fact that the only relief prayed for is for permission to settle the dues under One Time Settlement Scheme with respect to one loan.
In such circumstances, this writ petition is disposed of directing the 1st respondent to consider Ext.P3 application and grant permission to the petitioner to wipe off the liabilities by availing the benefit of the One Time Settlement Scheme. It is submitted that the Scheme is in force till 30.06.2022. The petitioner shall hence approach the 1st respondent before 30.06.2022, for consideration of Ext.P3 application. Necessary orders shall be issued by the 1st respondent soon thereafter. This Court is not stating any opinion regarding the other loans which are also overdue from the petitioner to the 1st respondent.
