Present petition has been filed under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr. P.C.') for grant of anticipatory bail to the petitioner in FIR No.62 dated 28.06.2017, under Sections 406, 420 of the Indian Penal Code, 1860 (for short 'IPC'), registered at Police Station Kathgarh, District SBS Nagar.

On 18.03.2019, while issuing notice of motion, this Court has passed the following order:-

"Contends that petitioner is ready to surrender before learned trial Court within two weeks from today.

Notice of motion for 06.05.2019.

In case petitioner surrenders before learned trial Court within two weeks from today and moves an application for bail, he be released on interim bail till the next date of hearing on his furnishing adequate bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate concerned."

Learned counsel for the petitioner has apprised this Court that in terms of order dated 18.03.2019, the petitioner has joined the proceedings before the learned trial Court and has furnished necessary bail/surety bonds.

Learned State counsel, on instructions from Assistant Sub Inspector Hans Raj, has acknowledged the above fact.

Accordingly, the interim bail furnished by the petitioner, before the learned trial Court, is made absolute.

Petition stands disposed off, accordingly.

As a deterrence, this Court deems it appropriate to impose costs in the sum of Rs.25,000/- on the petitioner. The costs shall be deposited within a period of one month from today, with the Headmistress of the Government Elementary School, Kathgarh and the said amount shall be utilized for the purpose of purchasing books for deserving students. In case, the costs is not deposited within the stipulated period, this order shall be deemed to have been cancelled automatically.

It is made clear that the petitioner shall fully co-operate with the learned trial Court for conducting smooth trial.
