4 paragraphs · 157 wordsNawab Singh, J.—This is an application for bail filed u/s 439 of Code of Criminal Procedure (for short ''Cr.P.C.'') by Chinder Singh in a case registered against him vide First Information Report (for short FIR) No.171 dated June 13,2007 u/s 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ''the Act'') in police station Bagha Purana.
The petitioner is in judicial custody since June 13,2007 on the accusation that he was found in possession of 70 kgs of poppy husk in the area of village Madhira, District Moga.
Contention of learned counsel for the petitioner is that no independent witness was joined during investigation and a false case has been registered against the petitioner.
Without expressing any opinion on the merit of the case, taking into consideration the grounds pleaded, it is ordered that petitioner be admitted to bail on his furnishing bail bonds to the satisfaction of the trial court.
