Rule returnable forthwith. The learned APP waives service of notice of rule for and on behalf of the respondent-State.

By this application, the applicant, an under-trial prisoner, arrested 01.01.2022 in connection FIR being C.R. No.11192050210614 of 2021 with the Sanand Police Station for the offence punishable under Sections-302 & 120B of IPC and Sec.135(1) of G.P. Act, prays for temporary bail for a period of 30 days on the ground of financial arrangement for his family and withdrawal of amount of provident fund, which is lying in the bank.

In the facts and circumstances of the case and taking into consideration the grounds urged in this application and past conduct of the applicant, the applicant is ordered to be released on temporary bail for a period of 10 days from the date of his actual release, on the applicant executing a bond of Rs.15,000=00 (Rupees Fifteen Thousand) to the satisfaction of the concerned authority, on usual terms and conditions.

As the matter is on the stage of recording of the evidence, the applicant shall not tamper or hamper with the evidence and shall not contact with the family of the victim or witnesses during the course of recording of evidence.

The applicant shall surrender before the jail authority on or before the expiry of the temporary bail period, without fail.

Rule is made absolute to the aforesaid extent. Direct service is permitted.

The Registry is directed to communicate this order to the concerned jail authority.
