Heard Sri K.R. Prabhakar, learned Counsel for the Petitioners (appearing through video conference) and Sri V. Ram Mohan, learned Counsel appearing on behalf of Sri G. Raju, learned Counsel for the sole Respondent.

The present Contempt Case is filed complaining of inaction on the part of the Respondent Authorities with regard to the Order passed by this Court dated 29.12.2023 in W.P.No.33461 of 2023. The operative portion of the Order dated 29.12.2023 is usefully extracted hereunder:

“4. In this view of the matter, liberty is granted to the Writ Petitioners to file a fresh Appeal before the appropriate Forum. The Appeal shall be taken on file without reference to the delay for the reasons mentioned hereinabove.

It is directed that from the date of filing of the Appeal the concerned Authority shall dispose of the Appeal within a period of three months after giving reasonable opportunity of hearing to the Petitioners/Appellants.”

After the above Order has been passed, the Writ Petitioners/Contempt Petitioners have filed a fresh Appeal on 01.02.2024 before the Principal Secretary, Department of Home. The Principal Secretary, Department of Home, had forwarded a copy of the Appeal to the Director General of Police on 21.05.2024. The Director General of Police had inturn forwarded the Appeal of the Petitioners to the Deputy Inspector General of Police, as the Deputy Inspector General of Police is the competent authority to decide the case of the Petitioners. Learned Counsel for the Respondent has also taken this Court to the relevant Rules that prescribe the competent Appellate Authority.

The Deputy Inspector General of Police had passed a Speaking Order dated 28.01.2025 and communicated the same to the Petitioners.

The above facts would indicate that the delay had been occasioned with regard to the disposal of the Appeal by the Official Respondents on account of presentation of the Appeal before a wrong Forum by the Petitioners.

In the present case, the Petitioners have wrongly presented the Appeal before the Principal Secretary, Department of Home.

In this view of the matter, this Court is of the view that the Order of this Court dated 29.12.2023 in W.P.No.33461 of 2023 has been complied with. Accordingly, the Contempt Case is closed. Needless to state that the Petitioners are at liberty to approach the appropriate Forum to challenge the Order passed on 28.01.2025 by the Deputy Inspector General of Police. No Order as to Costs.

Interlocutory Applications, if any, stand closed in terms of this order.
