After this application was heard for sometime, which is pending since 11 January 2022, in my opinion, it is appropriate that the prosecution takes an appropriate position and would finally inform the trial Court as to how many of the 77 witnesses would be examined so that the evidence on behalf of the prosecution is concluded as early as possible. This particularly in view of the fact that Mr. Lotlikar, learned Senior Counsel, has informed the Court that it appears not to be disputed that the trial is at the stage of evidence since almost five to six years. The trial cannot be delayed in such manner and moreso when the accused is in the judicial custody.

On instructions, it is informed by Mr. Bhobe, Public Prosecutor, that a computer expert who is from Hyderabad is being examined as a prosecution witness whose evidence is crucial as also the evidence of four other prosecution witnesses is scheduled to be recorded by the learned Trial Judge.

If that be so, in my opinion, it is appropriate that the testimony of such witnesses of the prosecution be completed at the earliest. In this view of the matter, it would be appropriate that the present application is disposed of, however, with liberty to the applicant to file an application for such reliefs as and when appropriate.

All contentions of the parties are expressly kept open.
