Deo Lal Prasad vs The State of Jharkhand and Others

Narendra Nath Tiwari, J.—In this writ petition, the Petitioner has prayed for a direction on the Respondents to promote him to the rank of Inspector of Police with effect from the date, the juniors were given promotion.

When the case is taken up today, learned Counsel for the Petitioner submitted that the Petitioner has been given promotion during the pendency of this writ petition by order dated 27th September, 2006, but promotion has not been given with effect from January, 2004 from which other similarly situated persons and even juniors to the Petitioner were given promotion. Learned Counsel, however, submitted that after the order of promotion, the Petitioner has not represented before the concerned authorities due to pendency of this writ petition.

Learned J.C. to A.G., appearing on behalf of the Respondents, submitted that if the Petitioner has any grievance against the promotion order, he can ventilate his grievance before the competent departmental authority. He further submitted that the Director General of Police, Jharkhand is the competent authority and the Petitioner can approach the said authority for the said grievance.

Considering the above, this writ petition is disposed of, giving liberty to the Petitioner to file representation, raising his said grievance of anomaly in giving him promotion before the Director General of Police, Jharkhand-Respondent No. 2. On receipt of the representation, the said Respondent shall consider the same and pass appropriate order, in accordance with law, within six weeks from the date of receipt of the representation. The Respondent shall also take into consideration the Petitioner''s claim that similarly situated persons and even juniors to him have been given promotion with earlier date.
