Judgment
S. Nagamuthu, J.—The petitioner''s name was sponsored by the Employment Exchange to the respondent for the post of Graduate Teacher. The interview was held on 24.09.2008. But she was not selected. According to the petitioner, her husband is working as Indo-Tibetan Border Police. Therefore, according to her, she is entitled for priority of G.O. Ms. No. 188, Personnel and Administrative Reforms Department, dated 28.12.1976. The petitioner asked for information under the Right to Information Act in respect of the above. The Information Officer of the respondent, by his Proceedings in O. Mu. No. 722/A3/A2/2008 dated 13.03.2009 informed the petitioner that the petitioner is not entitled for priority as per G.O. Ms. No. 188. Challenging the same, the petitioner is before this Court.
I have heard the learned counsel on either side and perused the records carefully.
For two reasons, the writ petition deserves to be dismissed. First of all, what is under challenge in this writ petition is only the information furnished under the Right to Information Act. If the petitioner has got any grievance regarding the said information, she can work out her remedy under the Right to Information Act itself. Secondly, going by the merits of the case, as rightly contended by the learned Additional Government Pleader appearing for the respondent, G.O. Ms. No. 188 directs that the priority in employment assistance through Employment Exchange shall be made applicable to all vacancies where they are filled up by priority or non-priority categories. The priority categories are destitute widows, inter-caste married couple, Ex-Servicemen and Ex-Indian Peace Keeping Force Personnel and the wives, sons and unmarried daughters of serving military personnel of Ex- Servicemen and Ex-Indian Peace Keeping Force. The petitioner''s husband is not a military personnel as he is working as Indo-Tibetan Border Police. Therefore, G.O. Ms. No. 188 is not applicable. Thus, the petitioner is not entitled for any relief as per the said Government Order.
In the result, the writ petition fails and accordingly it is dismissed. Consequently, the connected miscellaneous petition is closed. No costs.
