Petitioners claim to be engaged in the sale of fish in a market belonging to the Ulikkal Grama Panchayat. According to them, at the time when they were granted permission, it was informed that no other outlet would be permitted to sell fish within a distance of three kilometres from the existing market. However, contrary to the said promise, several people have started fish stalls in the nearby locality, putting the petitioners in great difficulty. Pointing out the above, a representation was submitted by the petitioners to the 2nd respondent on 03.11.2023. Petitioners allege that despite the said representation, no action has been initiated by the 2nd respondent and that other persons are continuing the business causing prejudice to the petitioners.

Having heard Sri. K.Aboobacker Sidheeque, the learned counsel for the petitioners, I am of the view that this writ petition can be disposed of dispensing with notice to respondents, considering the nature of the order I propose to issue.

Ext.P3 complaint is allegedly filed before the 2nd respondent. If the said representation had been received by the 2nd respondent already, necessarily a decision shall be taken by the 2nd respondent in a time bound manner.

Accordingly, there will be a direction to the 2nd respondent to consider and dispose of Ext.P3 complaint, if it had been received already, as expeditiously as possible, at any rate, within a period of 30 days from the date of receipt of a copy of this judgment.

Writ petition is disposed of as above.
