Judgment
Ravindra Maithani, J
Applicant is in judicial custody in FIR No.4 of 2024, under Sections 341, 504 IPC and Section 3(1)(D) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station Didihat, District Pithoragarh. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
According to the FIR, on 27.01.2024, when the informant was going towards hospital, he was way laid by various persons; he was insulted and humiliated and garland of the shoes was placed around his neck.
Learned counsel for the applicants as well as learned counsel for the informant would submit that they have settled the dispute amicably and the Co-ordinate Bench has stayed the proceedings of the trial court.
Learned State counsel would admit it.
Having considered the entirety of fact, this Court is of the view that the applicants deserve to be enlarged on bail
The bail application is allowed.
Let the applicants be released on bail, on their executing a personal bond and furnishing two reliable sureties by each one of them, each of the like amount, to the satisfaction of the Court concerned.
Let a copy of this order be supplied to learned counsel for the parties, today itself, on payment of usual charges.
