Dr. Jashvir Singh Malik vs Gurukul Kangri Vishwa Vidyalaya and Others

Barin Ghosh, C.J.—The subject matter of challenge in the instant writ petition is a suspension order dated 25th April, 2011. By that order, Petitioner has been suspended. In that, it has been stated that on 25th April, 2011, a letter has been received from Sri Virendra Singh Ashwal. With that, it has been stated that in the office Sri Virendra Singh Ashwal and Sri Sashikant misbehaved with the Vice Chancellor. If Sri Virendra Singh Ashwal and Sri Sashikant misbehaved with the Vice Chancellor, question of suspending the Petitioner did not arise. It may be possible, as is being contended by the Respondents, that the Petitioner misbehaved with the Vice Chancellor and the same was brought to the notice of the Administration by Sri Virendra Singh Ashwal. If that be so, then it was obligatory on the part of the Respondents to state so in the order of suspension. It is surprising that Gurukul Kangri Vishwa Vidyalaya, Haridwar and its officers are incapable to conveying, what they want to convey, while writing letters in Hindi. On the ground that the order impugned do not show any allegation against the Petitioner, on the basis whereof, the Petitioner can be suspended, we set aside the order. This order will not prevent the University to take such appropriate steps as the University is otherwise entitled to take against the Petitioner, but while taking such steps, it must act in a manner it is required to act.

The writ petition is disposed of accordingly.
