Notice. Mr. Ajay Vaidya, learned Senior Additional Advocate General, appears and waives service of notice on behalf of respondents No. 1, 2 and 4.
Learned counsel for the petitioner states that the issue in question is squarely covered by the judgments rendered by learned Single Judge(s) of this Court in CWPOA No. 1184/2020, Dr. D.R. Barwal(now deceased) through his legal representatives Smt. Usha Barwal & ors. Versus State of H.P. & ors. Dated 4.5.2021 (Annexure P-5) and CWPOA No. 1215/2020, titled as Dr. Kamal Kishore & anr. Versus State of H.P. & ors., dated 14.7.2021 (Annexure P-6). His statement is taken on record. This is a matter which is required to be determined by the respondents.
Accordingly, the instant petition is disposed of with a direction to the respondents to consider and decide the case of the petitioner in light of the aforesaid judgments within six weeks and in case the petitioner herein is found to be similarly situated as the petitioners in the aforesaid cases, then same and similar benefits be also extended to her. Pending application(s), if any, also stands disposed of.
