On 14-1-2021, this Court had passed the following order:
“Today, when the matter is taken up, I heard Mr. N. Surendrajit, learned counsel for the appellant and no one appeared for the respondent
whereas name of one Mr. Th. Ibohal Singh is printed in the cause list.
[2] Mr. N. Surendrajit, learned counsel for the appellant represented before this Court that the respondent in this second appeal already died in the last
occasion, he took time for taking steps for impleading LRs but Mr. N. Surendrajit, learned counsel for the appellant represented that he is unable to
contact his party as well as no person or respondent were also giving any appearance about the LRs of the respondent.
[3] Therefore, Mr. N. Surendrajit, learned counsel for the appellant seeks one more opportunity for getting instruction and to file appropriate LRs
petition for impleading LRs.
[4] Therefore, post the matter finally on 16.02.2021.
[5] It is made clear that if no step has been taken for impleading the LRs of the respondent, this second appeal RSA No. 8 of 2012willautomatically be
dismissed as abetted.
[6] Registry is directed to issue copy of this order to both the parties through their Whatsapp/e-mail.â€
Today, when the matter is called up, Mr. N. Surendrajit, learned counsel for the appellant submits that he has received no instructions to file the
appropriate LR Petition. He further submits that in view of the order dated 14-1-2021 passed by this Court, any appropriate order may be passed.
Mr. N. Surendrajit, learned counsel for the appellant submits that the respondent had died about four to five years back.
As the appellant had failed to file any application impleading the LRs of the deceased respondent till date, the present RSA stands abetted.
RSA stands disposed of.
