Barin Ghosh, C.J.—In the advertisement, it was announced that the post of Lecturer (Mathematics) is available for being filled up. The advertisement mentioned that qualifications shall be as per University Grants Commission (UGC) Rules. According to UGC Rules, for Lecturer in "Sciences", one is required to have good academic record with at least 55% of the marks or an equivalent grade of B in the 7 point scale with latter grades O, A, B, C, D, E and F at the Master''s degree level, in the "relevant subject" from an Indian University, or an equivalent degree from a foreign University. Respondent No. 5, who is having a Master''s degree in statistics, has been selected. The writ petition is by a person, who has a Master''s degree in mathematics. It is her contention that since Respondent No. 5 does not possess Master''s degree in mathematics, she was not eligible in terms of the advertisement, read with the Rules.

There appears to be no dispute that while a certificate has been issued, showing that the Petitioner has obtained Master''s degree in mathematics, a certificate has been issued showing that Respondent No. 5 has obtained a Master''s degree in statistics. A look at the mark-sheets of Petitioner and Respondent No. 5 would demonstrate amply that many of the subjects studied by them at the Master''s degree level were common. It has been submitted by the learned Counsel for the Petitioner that statistics is one of the subjects taught while one acquires a mathematics degree and, accordingly, mathematics encompasses statistics, but vice versa is not possible.

The relevant subject, in accordance with the Rules, is of the sciences. One of the sciences, no doubt, is mathematics. Statistics is not whole of mathematics, but it cannot be said that the same is not relevant to the science of mathematics.

Furthermore, the UGC itself has filed an affidavit and has stated that a person having Master''s degree in statistics had qualification in accordance with the regulations made by it for being appointed as a Lecturer (Mathematics).

We, accordingly, conclude the matter without interfering with the appointment of Respondent No. 5.
