Rongon Mukhopadhyay, J. - Heard Mr. Anand Kumar Sinha, learned counsel appearing for the petitioner, Mr. Md. Sohail Anwar, learned senior counsel appearing for the respondent no. 3, Sidhu-Kanhu Murmu University, Dumka, and learned J. C. to S. C. - II appearing for the respondent nos. 1 and 2.

The petitioner, in this writ application, has prayed for a direction upon the respondent no. 2 to fix the pay in the revised scale of Rs. 10,000 � 15,200/- w.e.f. 01.01.1996 at the rate Rs. 11,625/- per month as the pay of the petitioner was wrongly fixed and also to fix the petitioner�s pay in the replaced scale of Rs. 12,000-18,300/- and accordingly after rectification of the anomalies to revise the pension, gratuity and make payment of the subsequent arrears of such difference.

It has been submitted by the learned counsel for the petitioner that the Sidhu-Kanhu Murmu University, Dumka has already recommended the case of the petitioner before the respondent no. 2 as would appear from the letters dated 23.05.2013 and 11.04.2014. Learned counsel submits that the respondent no. 2 has not yet taken any action on the recommendation made by the University.

Mr. Md. Sohail Anwar, learned senior counsel appearing for the Sidhu-Kanhu Murmu University, Dumka, has submitted that it is the State Government which is to consider the claim of the petitioner as the University has already completed the requisite formalities.

Since the claim of the petitioner has already been recommended and the matter is pending before the respondent no. 2 this writ application is disposed of by directing the respondent no. 2 to take a considered decision on the recommendation made by the university as mentioned above within a period of twelve weeks from the date of receipt/production of a copy of this order.
