Judgment

While placing on record communication dated 19.9.2020, received from the office of Director, Ayurveda, Himachal Pradesh, learned submits that judgment alleged to have been violated stands duly complied with and as such, present contempt petition may be disposed of accordingly.
Aforesaid communication reveals that in compliance to judgment /order dated 8.8.2016 passed by the Erstwhile HP State Administrative Tribunal in TA No. 2104 of 2015, whereby respondents were directed to consider the case of the petitioner in light of the principles laid down in the judgment passed by this Court in CWP(T) No. 12595 of 2008 titled Dr. Amin Chand v. State of H.P., Government has accorded the approval for grant of benefit to the petitioner as per aforesaid judgment rendered by this Court in aforesaid CWP(T) No. 12598 of 2008. In terms of approval granted by the Government, the department concerned has revised the pay of the petitioner vide order dated 26.3.2018 and as per information furnished by the District Ayurvedic officer, Hamirpur, the total amount accrued on account of revised fixation is Rs. 3,56,300/-.
Sum of Rs. 1,42,560/- stands already paid to the petitioner in two equal installments of Rs. 71260. Third installment of Rs. 71260 is to be paid in the Financial year 2020-21. Rest of the amount is to be paid in five equal installments in view of the instructions of the Finance department issued vide letter No. Fin-E-C (17)-6/08 dated 7.1.2012.
Having perused aforesaid communication, this Court finds that necessary steps stand already taken at the behest of the respondents for implementation of the judgment alleged to have been violated and as such, nothing remains to be adjudicated in the instant proceedings and accordingly, same are closed. Notices discharged. However, liberty is reserved to the petitioner to file appropriate proceedings before appropraite court of law for surviving grievance if any.
