In 2019, the petitioner had applied for a number of her choice, i.e. Special Registration Mark. In this regard, Civil Writ Petition No.501 of 2019 filed
by her in this Court, was decided on 06.05.2019 by directing the respondents to temporarily provide her one choice number in ‘E’ series subject
to the condition that the petitioner was to be given a number of her choice as and when ‘F’ series starts. The operative part of the directions is
reproduced hereunder:-
“2. In such circumstances, we direct the respondents to provide the list of left out E series number to the petitioner. She may temporarily take one
of the numbers of her choice out of available numbers, subject to the condition that she will be given the number of her choice as and when F series
starts.
Learned Additional Advocate General on instructions undertakes that as and when F series will be started, the petitioner shall be allotted the
number of her choice out of that series. This would completely satisfy the petitioner’s claim, rendering this writ petition infructuous. Disposed of
as such.â€
In the instant writ petition, the grievance of the petitioner is that the respondents have though notified registration marks in HP34-F series, however,
she has not been allotted her choice number out of ‘F’ series till date. It is further submitted that under the gazette notification subsequently
issued by the respondents on 04.06.2020, the process of allotment of choice numbers has been amended and the same is to be provided through e-
auction system.
During hearing of the case, Sh. Hemant Vaid, learned Additional Advocate General has placed on record written instructions dated 08.02.2021
from the office of Registration & Licensing Authority, Kullu, admitting the factual position that vide notification No.TPT-C(9)-4/2003, dated
08.01.2021, registration marks in HP34-F series have been notified and the fact that the petitioner has submitted her application zeroing down her
choice of number/ registration mark to HP-34F-0007. On the basis of instructions imparted by Sh. Bhajan Singh, Law Officer of respondent No.2,
learned Additional Advocate General submits that the case of the petitioner for allotment of registration mark of her choice is under process and that
the respondent-Department has no objection for allotment of registration number preferred by the petitioner. However, since the process is to be
completed at the end of NIC, therefore, some delay has occurred in completing the same.
In the aforesaid facts and circumstances of the case, the present writ petition is disposed of with a direction to the respondents to complete the
process of allotment of registration mark preferred by the petitioner in terms of the judgment rendered by this Court in CWP No.501 of 2019, dated
06.05.2019, as expeditiously as possible, but not later than three weeks from today. All necessary formalities required to be completed at the end of
the petitioner be also got completed during the aforesaid period. Pending miscellaneous application(s), if any, also stand disposed of.
