By means of the writ petition, petitioner has sought indulgence of this Court for a direction to the respondent no.2 to take decision on petitioner’s representation dated 19.10.2023 (annexure no.18).

It is case of the petitioner that the petitioner was issued a contract in the year 2016 for construction of a bridge No.UID 9051 in district Pithoragarh. But when the bridge was partially constructed, unfortunately, in the intervening night of 29/30.07.2020, due to cloud burst the said bridge was swept away in flood. The petitioner raised a claim with regard to partially constructed bridge and claimed outstanding dues from his department by making an application to the department.

It is submitted by learned counsel for the petitioner that, that application of the petitioner is pending disposal, despite several representations having been made.

By means of the present writ petition, the petitioner made an innocuous prayer that if a direction is issued to respondent no.2 to decide the representation of the petitioner dated 19.10.2023 (annexure no.18) within a stipulated period, ends of justice would be met.

The proposition so raised by learned counsel for the petitioner is not opposed by learned State counsel.

Accordingly writ petition is disposed-off and it is provided that respondent no.2 shall decide the representation of the petitioner dated 19.10.2023 (annexure no.18) within a period of three months, from the date of production of certified copy of this order, positively taking into consideration the outstanding amount which was admitted by the respondent no.3 in its letter dated 06.08.2022 (annexure no.13).
