This writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking the following reliefs:-

"i) To direct the Respondent No. 1 to decide the appeal pending before the Respondent No. 1 within a period of 7 days.

ii) Allow the present Petition with Costs.

iii) Any other relief, this Hon’ble Court thinks fit in the facts and Circumstances of the case be also granted to the petitioner."

Admittedly, against the impugned order passed by the respondent No.2 Collector, Dhar on 14/11/2023, the petitioner has already preferred an appeal before the respondent No.1 Commissioner Indore Division, Indore under Section 9 of the Madhya Pradesh Rajya Suraksha Adhiniyam, 1990.

Counsel for the petitioner submits that the appeal is pending since last two months and the final hearing does not appear to be taking place in near future and it is submitted that if the appeal is not decided expeditiously, the whole purpose of filing the same shall stand redundant.

Counsel for the respondents/State submits that the appeal shall be decided expeditiously.

In view of the same, without adverting to the merits of the case, the writ petition is disposed of with a direction to the respondent No.1/Commissioner, Indore Division, Indore to decide the petitioner's appeal as expeditiously as possible preferably within a period of four weeks from the date of receipt of certified copy of this order.
