Heard learned counsel for the petitioner and Shri Suresh Chandra Srivastava, Advocate on behalf of the respondent Bank.
Petitioner has obtained loan for agricultural purposes. It is stated that under the Agricultural Debt Waiver and Debt Relief Scheme, 2008, he is entitled to monetary benefits flowing there from. The application made by the petitioner for the purpose has not been considered by the Bank. He has, therefore, approached this Court for a writ of mandamus commanding the respondents to consider his application made under the Agricultural Debt Waiver and Debt Relief Scheme, 2008.
Counsel for the Bank submits that in case the application is made by the petitioner, the same shall be considered by the Branch Manager.
This writ petition is disposed of with liberty to the petitioner to make a fresh application before the Branch Manager concerned, within two weeks from today, along with a certified copy of this order. On such an application being made, the Branch Manager shall consider the same and take appropriate decision strictly in accordance with the Agricultural Debt Waiver and Debt Relief Scheme, 2008, preferably within four weeks, thereafter.
It is made clear that any recovery proceedings already initiated, shall not, in any way, be effected by this order.
