Ghanshyam Agarwal vs State of Jharkhand and Others

Aparesh Kumar Singh, J.—Heard counsel for the petitioner as well as counsel for the respondent-State. The grievance of the petitioner is that a multi storied building is being constructed by the Respondent Nos. 4 to 6 on the plot adjacent to his land. Petitioner has made complaint before the Respondent No. 3-Jamshedpur Notified Area Committee, which however has not taken any action. A perusal of the writ application however shows that petitioner has failed to make any statement about his own plot in writ petition rather he has mentioned only about the plot Nos. of the private respondents in the main body of the writ application.

It appears that there is a inter se dispute between the petitioner and the private respondents. Therefore, without getting into the merit of the case, the writ petition is disposed of by allowing liberty to the petitioner to pursue his complaint before the Respondent No. 3, Jamshedpur Notified Area Committee, which will look into the grievances of the petitioner in accordance with law within reasonable time. The writ petition is disposed of in the aforesaid terms.
