When this matter was taken up today, the learned counsel for the petitioners submitted that except petitioners 10 to 13 and 17, none others are

interested in pursuing this writ petition any further. He further submitted that these petitioners are also giving up their contentions against Exhibits P14

and P15 orders, but that they be given the same benefits, as have been ordered by a learned Division Bench of this Court in Exhibit P16 judgment. He,

therefore, prayed that the Kerala State Electricity Board (KSEB) be directed to consider the claims of the petitioners on the basis of the declarations

contained in Exhibit P16 judgment, within a time frame to be fixed by this Court.

The learned Standing Counsel for the KSEB submitted that since the petitioners 10 to 13 and 17 are now giving up their contentions against Exhibits

P14 and P15, this writ petition is no longer maintainable. However, to a pointed question, he submitted that if the petitioners require a consideration by

the competent authority of the KSEB as to whether the declarations in Exhibit P16 would apply to them, he would not stand in the way of this Court

issuing such directions.

In the afore circumstances and recording the submissions of the learned counsel for the petitioners as afore, I order this writ petition, to the limited

extent of directing the KSEB to consider the case of the petitioners â€" who have expressly given up their contentions against Exhibits P14 and P15

â€" on the touch stone of the declarations in Exhibit P16 judgment.

The afore exercise shall be completed by the competent authority of the KSEB as expeditiously as possible and the resultant communication shall be

issued to petitioners 10 to 13 and 17 within a period of three months from the date of receipt of a copy of this judgment.
