Barkat Ali Zaidi, J.—The accused applicant is charged in case Crime No. 1338 of 2007 under sections 363, 366 and 376 IPC Police Station Civil Lines, District Rampur.

Heard Sri Abhinav Prasad advocate for the applicant and Sri N.D. Rai, Addl. Government Advocate for the State.

According to the first information report lodged by the father of the prosecutrix, the accused came to the house of the complainant at mid night and eloped with his daughter. They lived in Bareilly, whereupon she came back after about 3 months. The medical examination indicates that the age of the prosecutrix is 18 year. It is manifest that the girl herself has gone at the mid night with her own free will with the accused and that itself is suffice for bail.

The applicant Gulab Singh be released on bail in the aforenoted crime, on his furnishing a personal bond of Rs. fifteen thousand with one surety in the like amount to the satisfaction of the Chief Judicial Magistrate, Rampur.
