Judgment
M.R. Shah, J.—Special Civil Application No. 5183 of 2008 has been preferred by the Petitioner management to quash and set aside the impugned judgment and award dated 26.11.2007 passed by the Presiding Officer, Labour Court, Ahmedabad passed in Reference (LCA) No. 1163 of 1997 in so far as directing the Petitioner to pay lump sum monetary compensation to the respective workmen- Respondents herein.
1.1. Special Civil Application No. 11009 of 2008 has been preferred by the concerned workmen, which can be said to be cross petition to Special Civil Application No. 5182 of 2009.
2 Today, when both these petitions are taken up for hearing, Shri Chauhan, learned advocate for the Petitioner-management as well as Shri Chaudhary, learned advocate for the concerned workman have produced on record the consent terms arrived at between the respective parties and it is signed by the Respondent workmen and so far as management is concerned, it is signed by the Manager who is personally present in the Court. Therefore, it is requested to dispose of both these petitions in terms of consentter Ms. The aforesaid consent terms is directed to be taken on record and both these petitions are disposed of in terms of consent terMs. Rule discharged in each of the petitions. Registry is directed to pay sum of Rs. 40,000/- to Respondent No. 1 Premila Ben Vithal bhai Parmar and Rs. 16,000/- each to Respondent Nos. 2 and 3 i.e. Hira Ben Babu Bhai Parmar and Jasuben Vasta Bhai Jadav by Account Payee Cheque on due verification (out of the amount of Rs. 72000) which is reported to have been deposited by the Petitioner pursuant to the order passed by this Court dated 15.12.2008 passed in Special Civil Application No. 5183 of 2008 at the earliest.
